DA Won't File Felony Charges In Crutch Beating

The District Attorney's Office declined today to file a felony case against a homeless man accused of beating two others with a crutch amid a five-person fight, but city prosecutors could still opt to bring misdemeanor charges.
The case against 57-year-old Clinton Tripp was initially reviewed by the City Attorney's Office, then turned over to the District Attorney's Office, spokesman Steve Walker said.
Prosecutors decided not to charge Tripp and referred the case back to city prosecutors for the possible filing of misdemeanor charges, he said.
Tripp was arrested shortly after the fight near Pacific Highway and Rosecrans Street about 7:15 p.m. Friday, and booked on suspicion of attempted murder, police said.
Two injured men were taken to a hospital.
It was not clear if Tripp -- held on $10,000 bail -- would be immediately released from jail.
